Attorney Riggs presented the proposed 2023 rate increase for general civil and prosecution matters.
The 2023 rates took effect without a recorded vote, and the council corrected the practice a year later. The February 2023 minutes record only that Attorney Riggs reviewed the rates, but the January 2024 packet treats 188 dollars an hour as the rate already in force for 2023, and on February 13 2024 the council formally approved the 2024 schedule 5-0-0 on a motion by Henke seconded by Helgeson.
The 2023 increase from 180 to 188 dollars an hour is treated in the 2024 packet as the operative rate even though no council action approving it appears in the record.

Update on an ongoing nuisance property enforcement matter.
The citation was issued January 10 2023 with arraignment set for February 23. By April 11 2023 snow had slowed the cleanup, the owner had surveyed the property, found the downed tree was on his land and agreed to remove it, and he had until April to finish. Enforcement ran on into June 2023, when a resident told the council he believed the owner had met the conditions of the abatement order.

They will begin working with property owners on the needed easements in this area soon. 2023 Street Improvements City Engineer Olinger stated that the design work for this project will begin once the sewer project design is completed sometime this spring.
Project update on Pearl Creek Sanitary Sewer Improvements design.
Easement work began and centered on one property. By March 14 2023 the construction plans were complete and easements were being worked, and by April 11 2023 the engineer reported an extensive amount of easement and grading work affecting the Barrett property, where a mutually agreeable location for the new infrastructure may have been reached, with negotiations continuing with all owners. The Barrett property was still causing restoration problems at project closeout in early 2025.

It did not produce a new plan document: as of May 2025 Northland's last prepared financial management plan for Kenyon was still the 2021 one, updated that year against Bolton and Menk's 2025 Infrastructure Management Plan.

The 2023 street design followed the sewer design and reached bid by June. Resolution 2023-13 accepting the bid for the 2023 Street Improvement Project was on the June 13 2023 agenda alongside the Pearl Creek bid and a 34,935 dollar chip sealing quote from Corrective Asphalt Materials. The street contract went to Bituminous Materials at 450,693.95 dollars against a 547,705 dollar estimate, 97,011.05 dollars under.

ENGINEERING General Project Update Pearl Creek Sanitary Sewer Improvements Engineer Olinger stated that the construction plans for the Pearl Creek Sanitary Sewer improvements are about 50% completed.
Engineering project update.
Design finished within two months. By March 14 2023 the Pearl Creek plans were complete with the forcemain route modified for capacity at no increase in project cost, and the contract was awarded to BCM Construction at 1,241,494.22 dollars against a 1,536,065 dollar estimate. Minger bid 1,327,721.90 dollars and Heselton 1,385,155.00 dollars.
The July 11 2023 packet still describes the Pearl Creek plans as complete and ready to advertise for bids although the council had already accepted BCM's bid on June 13 2023.

This increase would raise the hourly base rate for general civil and prosecution matters from $180.00 to $188.00 an hour. The other associated rates would also increase $9.50 to $14.00 per hour.

The 2023 rates were superseded a year later by a bigger increase. The 2024 schedule set 196 dollars an hour for general civil and prosecution, 231 dollars for litigation, development, real estate, telecommunications and employment matters, and 276 dollars for pass through matters billed back to developers, approved 5-0-0 on February 13 2024. The base rate rose from 180 to 196 dollars across the two years, 8.9 percent.

Proposed 8% Increase to Sanitary Sewer Rates Administrator Vahlsing stated that an 8% increase to the 2023 Sanitary Sewer Budget was reviewed at the work session in October 2022. An increase to existing sewer rates is necessary due to a projected shortfall.
Justification for the 8% sanitary sewer rate increase.
The shortfall figure never appears, but the rate path built to close it does. Sanitary sewer went from 6.61 to 7.40 dollars per thousand gallons for 2024 with the residential base from 23.44 to 26.25 dollars a month, then to 7.77 dollars per thousand and a 27.57 dollar base for 2025, while the storm water fee went from 4.03 to 9.00 dollars a month and then to 13.00 dollars. That is a four year plan drawn from the 2021 utility rate study, with each year approved separately. The 2023 sewer budget showing projected revenues against expenses would settle the shortfall amount.

We hold no side by side comparison of the 2022 and 2023 fee schedules, so the claim of no change rests on the administrator's statement. The pattern broke immediately after: the 2024 schedule carried a few increases, and by June 2024 the council had to adopt Resolution 2024-13 because the Sunday on-sale liquor and bad check fees set in January exceeded statutory ceilings of 200 dollars and 30 dollars. The council kept the bad check charge at 45 dollars and changed only the wording.

Kennedy & Graven 2023 Rates for Legal Services
Attorney Riggs reviewed the rates for legal services for 2023. This increase would raise the hourly base rate for general civil and prosecution matters from $180.00 to $188.00 an hour. The other associated rates would also increase $9.50 to $14.00 per hour.

Financial Impacts, George Eilertson – Northland Securities Administrator Vahlsing requested that a work session be scheduled for George Eilertson and the City Engineer to review the estimated financial impacts and payment options for the 10-year Infrastructure management plan.

Administrator Vahlsing stated that an 8% increase to the 2023 Sanitary Sewer Budget was reviewed at the work session in October 2022. An increase to existing sewer rates is necessary due to a projected shortfall.
Motion by Ryan second by Bailey to approve the proposed 8% increase to the sanitary sewer rates beginning with the April billing period that begins March 15, 2023.
